It appears from the order dated February 28, 2008 that the petitioner has been enjoying a stay with regard to Birpara P.S. Case No. 7/02 dated 17.01.02 under Sections 406/409 of the Indian Penal Code. No application has ever been filed by the petitioner for the purpose of extending the stay.

In light of the same, I am of the view that the petitioner is no longer interested in pursuing this lis. I make it clear that all interim order shall stand vacated.

Accordingly, this criminal revisional application is dismissed for default.

The department shall communicate the order passed in Court today to the court below.

The department concerned shall ensure the acknowledgement of receipt of such communication. A report of compliance to be placed before this Court after two weeks.

The lower court is directed to expeditiously act in accordance with law.
