And In Re: Baban Barui @ Baban Bauri ....Petitioner Mr. Sabir Ahmed Mr. Sudip Kushari Mr. Qazi Ezaz Ahmed Mr. Dilwar Azad ...for the Petitioner Mr. Arindam Sen Ms. Mousumi Sarkar ...for the State It is an acknowledged position before this Court that the petitioner is similarly circumstanced with the other two accused persons, who have already been granted bail by this Court. It further appears that the victim lady was declared hostile by the prosecution in course of her deposition. I find no justification to keep the petitioner in custody any further.

Having regard to the aforesaid, the prayer for bail is allowed.

Accordingly, the petitioner shall be released on bail upon furnishing a bond of Rs. 10,000/- with two sureties of the like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Ghatal, Paschim Medinipur.

It is further directed that the petitioner shall appear before the learned trial Court on every date of hearing until further orders and shall not intimidate any witnesses or tamper with evidence in any manner. Failure on the part of the petitioner to comply with the aforesaid conditions shall entitle the learned trial Court to cancel the bail granted to the petitioner in accordance with law, without any further reference to this Court. Accordingly, CRM (M)373 of 2026 stands allowed. (Kausik Chanda,J.)
