The writ petitioner claims that his terminal benefits have not been properly calculated and has made an application before the Divisional Manager, Raghunathganj Division, WBSEDCL, Murshidabad. It appears from the records that a clarification has been sought from the General Manager (HR) of the WBSEDCL by the office at Murshidabad on 29th May, 2018.

The dispute centres around the period of incarceration of the petitioner in connection with a criminal proceeding. The petitioner admittedly has been acquitted and post incarceration he has also jointed duties with the WBSEDCL.

In the above circumstances, the respondent no. 2-the General Manager (HR &A),

WBSEDCL shall consider and dispose of the petitioner's representation contained at page 35 of the writ petition. The writ petition itself may also be considered by the respondent no. 2 in the above process.

It is expected that the respondent no.2General Manager (HR &A), WBSEDCL shall pass suitable orders within a period of two months from the date of communication of a copy of this order and the same may be communicated to the petitioner within seven days thereof.

Any entitlement found payable to the petitioner including any pensionary benefits may be released to him in accordance with law, post consideration, as above. In this regard, if the petitioner is required to comply with any formalities, the same shall be done.

With the aforesaid directions, the instant writ petition is disposed of.

All parties are directed to act on a server copy of this order on usual undertakings.
