Learned advocate for the petitioner submits that the petitioner was arrested on 24th August, 2020 and since then he is in custody. Additionally, learned advocate submits that on any condition the petitioner may be released on bail.

Learned advocate for the State opposes the prayer for bail as the phensedyl was recovered from the possession of the present petitioner, and submits as such the provision of Section 37 of the NDPS Act is attracted.

We have perused the materials on record and having regard to the fact that seizure of commercial

quantity was from the petitioner, we are not inclined to grant bail to the petitioner.

The application being CRM 1196 of 2021 is, thus, rejected.
