Ms. Amrita Panja Moulick ....for the State Mr. Pappu Adhikari ....for the respondent No.6 The petitioner has sought for multiple reliefs in this writ petition including transfer of investigation of the criminal proceeding being Narkeldanga Police Station Case No.332 of 2025 to a competent agency and/or higher police officer as may be decided by this Court and to locate and arrest the respondent No.6 and to take him into custody and for other directions.

After some argument, Mr.

Banerjee, learned advocate for the petitioner, on instruction, submits that he is restricting his claim in the writ petition to the effect that the respondent authorities should be directed to complete the investigation within specified period of time and the police authority should be directed to provide adequate protection to the petitioner and her minor child from all

threats, intimidation and harassment by the respondent No.6.

The respondent No.6 is represented by the learned advocate. The learned advocate for the respondent No.6 denies the allegations made by the petitioner against the respondent No.6.

Mr. Sengupta, learned senior Government advocate submits that investigation is in progress and the question of taking the respondent No.6 in custody falls within the domain of the investigating officer and if the detention of the respondent No.6 is necessary for the purpose of effective investigation, such steps will be taken. Such submission of Mr. Sengupta is placed on record. Insofar as the allegations of the petitioner that the investigation is not being proceeded with expeditiously, the writ petitioner is left free to approach the concerned jurisdictional magistrate ventilating his grievances in that regard in accordance with law.

Insofar as the prayer of the petitioner to provide adequate protection to herself and her minor child, this Court grants liberty to the petitioner to file an appropriate application before the concerned authority praying for necessary protection to herself and her minor child from all threats, intimidation and harassment by the respondent No.6 and if such authority is approached, immediate steps shall be taken in accordance with law upon being satisfied with the need for such protection.

With the above observations WPA 2851 of 2026 stands disposed of.

There will be no order as to costs.
