Since the petitioner seeks expeditious disposal of C.S.No. 56337 of 2023 pending before the learned Judicial Magistrate, 9th Court, Calcutta, the matter may be disposed of without service of notice upon the opposite party. The opposite party shall not be prejudiced by an order directing expeditious disposal of the case. This Court is informed that the accused/ 2nd opposite party surrendered before the learned trial Court and was granted bail on July 27, 203. Thereafter, the opposite party failed to appear before the Court for which warrant of arrest was issued against him by an order passed on August 05, 2024. Since then several dates have been fixed for execution return. The warrant has not been executed, nor has the accused/ opposite party surrendered before the learned trial Court. The learned trial Court is unable to proceed with the matter any further.

In view of the above, the learned trial Court is directed to take necessary steps for securing the attendance of the accused/opposite party before him and take the proceedings to its logical conclusion as expeditiously as possible, without granting

any unnecessary adjournment to either of the parties, in accordance with law.

With the above observations and directions the instant revisional application being CRR No. 540 of 2025 is disposed of. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
