This revisional application under Section 115 of the Code of Civil Procedure challenges the Order No. 31 dated 18th January, 2003 passed by the learned Additional District Judge, Fourth Court at Midnapore in Misc. Appeal No. 40 of 1999 arising out of Title Suit No. 43 of 1999.

By the impugned order, the learned Appellate Court impliedly refused to extend the order of interim injunction passed on 18th May, 1999.

It is submitted that subsequently the injunction application was disposed of with certain direction upon the learned trial court and upon the parties for expeditious disposal of the suit and till then, the order of injunction to continue till disposal of the suit. Thus, this revisional application has lost its relevance and is disposed of being "infructuous".

The photocopy of the order passed in Misc. Appeal No. 40 of 1999 is taken on record.
