For the State The claim of the petitioner was for arrear Court No. 22 14.9.2023 (Item No. 8) (AB) salary and incremental benefit during the year 1991 to 1993.
Mr. Gouranga Kumar Das, learned advocate appears for the petitioner has confirmed that, the entire principal amount to the extent of Rs.1,18,050/- for the said period has already been received by the petitioner. The petitioner now claims interest. Taking an equitable view on the issue the respondent authorities shall a lump sum amount of Rs.80,000/- to the petitioner on account of interest and no further.
The respondent No. 3 is directed to take all necessary and consequential steps in this regard and send the relevant papers before the respondent No. 5 positively within a period of three weeks from the date of communication of this order.
The respondent No. 3 then after receiving the bank details from the petitioner shall release the amount as directed above in favour of the petitioner
positively within a further period of two weeks from the date of receiving the communication from the respondent No. 3. This order shall be treated that no further claim of the petitioner shall exists on account of interest on the issue.
On the above terms this writ petition W.P.A.
1898 of 2020 stand disposed of.
There shall be no order as to costs.
Urgent certified photo copy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
