At the time of hearing, Mr. Chatterjee, learned advocate appearing on behalf of the alleged contemnor at the very outset draws attention of this Court to a copy of the order dated 06.05.2025 as issued by the Additional Secretary, Government of West Bengal, Department of Industry, Commerce and Enterprises (Mines Branch) which has been forwarded to the writ petitioner.

It is submitted by Mr. Chatterjee that from the last paragraph of the said order dated 06.05.2025, it would reveal that the present writ petitioner was requested to submit a draft copy of the mining lease deed as per West Bengal Minerals Concession Rules, 2016 duly filled in for execution of the same. It is further submitted by Mr. Chatterjee that such order dated 06.05.2025 was issued and was communicated to the writ petitioner in compliance of the judgment and order dated 28.03.2025 as passed by this Court in WPA 2649 of 2025.

At this juncture, this Court asked the petitioner, Dinesh Agarwal as to whether he has submitted the draft copy of

the mining lease deed to which he has submitted before this Court that he has not submitted such draft copy. 4.

On being repeatedly asked by this Court, Mr. Dinesh Agarwal further submits before this Court that he is not ready and willing to submit the draft copy of the mining lease deed as called for.

Such being the position, this Court considers that because of the non-cooperation of the petitioner, Dinesh Agarwal, the alleged contemnor is practically handicapped to comply with the judgment and order as passed by this Court on 28.03.2025 in WPA 2649 of 2025.

With the aforementioned observations, the instant contempt application being CPAN 922 of 2025 is dismissed.
