1. Nobody appears on behalf of the appellant/convict.
2. State is represented by the learned advocate.
3. In pursuance of the direction passed by this Court, a report is submitted by the Commissioner of Police, Chandannagar Police Commissionerate indicating that during pendency of this appeal, the sole appellant/convict, Jhulan Tewari @ Shivji Tewari has been expired on 13.8.2023. A photocopy of certificate of death of the said appellant/convict which was collected and tagged in this report also affirms the death of the appellant/convict, Jhulan Tewari @ Shivji Tewari.
4. As the sole appellant/convict has been expired during pendency of this appeal, the instant appeal stands abated against him.
5. Accordingly, the instant appeal be and the same is hereby dismissed as abated. The Criminal Appeal being CRA 191 of 1990 is hereby disposed of.
6. A report is submitted by the Commissioner of Police, Chandannagar Police Commissionerate and handed over by the learned advocate during the course of hearing. The same be kept with the record.
7. Let a copy of this order along with TCR be sent down to the learned Trial Court immediately.
8. Urgent photostat certified copy of the order, if applied for, be given to the parties upon complying with all legal formalities. (Prasenjit Biswas, J.)
