Despite service of notice, private respondents are not represented. Affidavit of service filed in Court today is taken on record.

The petitioner seeks to enforce an order of injunction dated 14th October, 2020 passed by the Learned Civil Judge (Junior Division), 4th Court, Howrah in TS No.917 of 2020. The Civil Judge has directed the Golabari Police Station on 25th April, 2022 to ensure that the boundary wall of the petitioner is not damaged in any way by the private respondents. The suit is pending.

Mr.

Chakraborty, learned counsel for the petitioner submits that the injunction is subsisting even as on date.

Learned counsel appearing for the Golabari Police Station submits that the private respondents have been warned by the Officer-in-Charge, against any construction that would damage the petitioner's boundary wall.

In the above circumstances, the Golabari Police is directed to strictly enforce the order of injunction referred to hereinabove passed by the Civil Court and also address any variation or modification thereof. With the aforesaid directions, the writ petition shall stand disposed of.

There shall be no order as to costs.

The report of the Officer-in-Charge, Golabari Police Station dated 14th March, 2023 is taken on record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
