Petitioner renews the prayer for bail on the ground of parity. According to him, subsequent to the earlier order of rejection, other co-accused were enlarged on bail. Learned advocate appearing for the State draws the attention of the Court to the contents in the case diary. Considering the materials in the case diary including the statement of the driver implicating the petitioner, we are of the view that the petitioner does not stand in the same footing as that of the other co-accused who were granted bail by the coordinate bench and considering the gravity of the offence and the involvement of the petitioner therein, we are unable to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner is rejected.

C.R.M. (DB) 441 of 2022 is dismissed.
