Kapas ... for the State This is an application under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by the inaction on the part of the respondent authorities in considering his representation dated September 16, 2019 in relation to refund of his Pension Payment Order in terms of ROPA, 2009 and payment of arrear salary for the period from 01.04.2008 to 31.03.2009.

Chaitali Bhattacharya, learned Counsel appearing on behalf of the State fairly submits that the matter may be remanded to the concerned District Inspector of Schools (S.E.) for taking a decision in this matter. In light of the above submission, the Additional District Inspector of Schools (S.E.), Uluberia, District Howrah, being the respondent no.3 herein to grant an opportunity of hearing to the petitioner and pass a reasoned order within a period of eight weeks from date. The

reasoned order is to be communicated to the petitioner within a period of two weeks thereafter.

With the above directions, this writ petition is disposed of.

Since no affidavit-in-opposition is called for, allegations made in the writ petition are deemed not to have been admitted.
