The said report reflects that challenging the order passed by learned Executive Magistrate, Tamluk, Purba Medinipur in connection with M.P. Case No. 371/2019 under Section 145 of the Code of Criminal Procedure, a revisional application was preferred by the respondent no.4, viz. Bela Rani Hazra.
The said revisional application being Criminal Revision No. 94 of 2019 is presently pending before learned Additional Sessions Judge, Fast Track 1st Court, Tamluk and the next date has been fixed on 23.12.2024 as is reflected from the report.
The learned Additional Sessions Judge, Fast Track 1st Court, Tamluk is directed that if no notice has already been issued in the present revisional application upon the petitioner before this Court viz. Sanjib Dolai, steps be taken by the learned Additional Sessions Judge being the revisional
court to ensure that notice be issued upon the affected party, viz. Sanjib Dolai.
The petitioner before this Court is also granted liberty to approach the revisional court being the learned Additional Sessions Judge, Fast Track 1st Court, Tamluk in connection with Criminal Revision Case No. 94/2019.
The petitioner would be at liberty to pray for vacating the interim order and/or further pray for preponing of the date which has already been fixed by the learned revisional court.
With the aforesaid observations, the writ petition being WPA 1927 of 2020 is disposed of. Pending connected application, if any, is consequently disposed of.
There shall be no order as to costs.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
