Rakib (Allowed) CRM (M) 376 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Islamppur Police Station case no. 621 of 2020 dated 04.08.2020 under Sections 302 of the Indian Penal Code.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for five years seven months and only four witnesses till date have been examined out of the cited eight witnesses proposed by the prosecution.

Learned advocate for the State opposes the prayer for bail. However, having taken into consideration the period of detention of the present petitioner and without entering into the merits of the case, I am inclined to release the petitioner on bail as the trial is unnecessarily consuming time. Accordingly, the prayer for bail of the petitioner is allowed.

Accordingly, petitioner namely, Ramesh Minj @ Oraw shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction

of the learned Additional District and Sessions Judge, Fast Track, Court-I, Islampur, Uttar Dinajpur.

If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial Court and shall not leave the jurisdiction of District of Uttar Dinajpur without the prior permission of the learned trial Court.

Further, petitioner shall once in a week for the period of next six months attend the Islampur Police Station and obtain an acknowledgment in respect of his attendance.

If there is any violation of the aforesaid conditions, the learned trial Court will be at liberty to cancel the bail application without further reference to this Court.

Accordingly, the application for bail being CRM (M) No. 376 of 2026 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
