Mr. Pachhal, learned advocate is aggrieved by the orders passed by the learned Chief Judicial Magistrate, Howrah in Misc. Execution Case No. 08 of 2014.

Learned advocate submits that the opposite party/husband is evading the process of the court in the execution proceedings and the warrant so issued are not even executed and in fact the present petitioner is starving.

Learned advocate for the petitioner has drawn the attention of the court to an application which was filed as also the prayer in the present revisional application wherein details have been provided regarding SB A/c. No. 17580110018576 maintained with UCO Bank, Bamungachi Branch. The learned Magistrate would in the circumstances at least attach the current monthly maintenance of the lady from the said account until the opposite party appears before the court. The learned court would thereafter facilitate with such amount which is attached is handed over to the lady through proper process of law within a scheduled time. C. J. M., Howrah will bring the order of this court to the learned Magistrate. The learned Magistrate within a week from the said date would pass his orders for giving effect to the proceedings in such a manner that the lady at least receives the current amount. So far as the arrears are concerned, the learned Magistrate would proceed in accordance with law and compel the appearance of the opposite party by exhausting other process of law. With the aforesaid observations, the present revisional application being CRR 392 of 2023 is disposed of. Pending applications, if any, are consequently disposed of All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court.
