For the State By this writ petition, the petitioner prayed for a direction upon the respondents to give appointment to him in the Group-C post on compassionate ground. The petitioner's father, while working as 'Record Keeper' in the Judgeship of District, Purulia , died-inharness on 20th May, 2002. The petitioner was appointed in the Post of LDC (Group-C) on compassionate ground by an order dated 27th August, 2002 issued by the District Judge, Purulia. The petitioner joined in service on 7th September, 2002.
On 24th September, 2003, the Respondent No.3 terminated the service of the petitioner. The petitioner assailed the order of termination by taking out an Original Application being OA No.1015 of 2005 which was disposed of on 02/01/2006 directing the respondent no.2 to consider the original application as a representation and pass a reasoned order. Pursuant to a Memo dated 08/09/2006, respondent no.
a letter of appointment in favour of the petitioner for the post of Peon (Group-D). The petitioner joined in the Group-D post on 21/01/2006.
Thereafter the petitioner has preferred this writ petition seeking his appointment in the post of Group-C.
During course of hearing, Mr. Acharya , learned advocate for the petitioner submits, upon instruction, that during pendency of the writ petition the petitioner has been promoted the Post of Group-C.
In view of such submission made on behalf of the writ petitioner, no further order is required to be passed in the writ petition. Consequently the writ petition stand disposed of.
There shall, however, be no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied as expeditiously as possible. (Partha Sarathi Chatterjee, J.)
