It is submitted on behalf of the petitioner no narcotics was recovered from his possession. Petitioner has been falsely implicated. Investigation is complete. Accordingly, he prays for anticipatory bail. 2.

Learned Advocate for the State opposes the prayer for anticipatory bail and submits petitioner has criminal antecedents. 3.

We have considered the materials on record. 14.1 kgs. of Ganja was recovered from co-accused. Petitioner's complicity transpired from the statement of co-accused before police officer which is inadmissible in law. Investigation is complete. Under such circumstances, we are of the opinion custodial interrogation of the petitioner is not necessary and he may be granted anticipatory bail.

Accordingly, we direct in the event of arrest, the accused/petitioner, namely, Saiful Sekh @ Saiful Sk., be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only), with two sureties of like amount each, to the satisfaction of the arresting officer and also subject to the conditions as laid down under Section Signed By : ARUP KUMAR DAS High Court of Calcutta 12 th of February 2025 03:53:03 PM
