Banerjee) Mr. Pulakesh Bajpayee Mr. Kushi Prasun Chatterjee ...for the petitioners This application under Article 227 of the Constitution of India is at the instance of the General Manager, Chittaranjan Locomotive Works and Principal Chief Medical Officer challenging the order dated August 13, 2024 and November 22, 2024 passed by the Central Government Industrial Tribunal-cum- Labour Court Asansol in Application No. 3 of 2018. By the order dated August 13, 2024 the respondents were directed to take steps on the next date by filing fresh Vakalatnama as well as written statement duly executed by the concerned person. By the order dated November 22, 2024 the Presiding Officer CGIT-cum-Labour Court, Asansol directed the General Manager and Chief Personnel Officer of Chittaranjan Locomotive Works to submit explanation as to why written statement has not been filed before the Tribunal in a proper manner even after these orders.
Learned advocate for the petitioners submits that Chittaranjan Locomotive Works has filed written statement and there is no necessity to file a separate written statement by its officers.
Such submission of the learned advocate for the petitioners is placed on record.
In the light of the aforesaid submission made by the learned advocate for the petitioners, this Court directs the Central Government Industrial Tribunalcum-Labour Court, Asansol to proceed with the hearing of the application no. 3 of 2018 in accordance with law without insisting for filing of the written statement by the General Manager and Chief Personnel Officer of Chittaranjan Locomotive Works. With the above observations and directions CO 408 of 2025 stands disposed of.
