Mr. Lakshminath Bhattacharya ...for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Senior Division), 1st Court at Tamluk, Purba Medinipur to dispose of the application under Order VII Rule 11 of the Code of Civil Procedure filed on 7th May, 2024 and to dispose of the Title Suit No. 104 of 2022 expeditiously. Learned advocate for the petitioner submits that the application under Order VII Rule 11 of the Code of Civil Procedure is otherwise ready for hearing.

In view of the order sought and proposed to be passed, this Court feels that there is no necessity to direct issuance of any notice upon the opposite party. However, learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party or upon the learned advocates representing the opposite party before the learned Trial Judge.

In the light of the said submission, CO 454 of 2025 is disposed of by requesting the learned Civil Judge (Senior Division), 1st Court at Tamluk, Purba Medinipur to take up the hearing of the application under Order VII Rule 11 on the next date fixed and to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties. Depending upon the fate of the application under Order VII Rule 11 of the Code of Civil Procedure, the learned Civil Judge (Senior Division), 1st Court at Tamluk, Purba Medinipur shall make endeavors to dispose of the Title Suit No. 104 of 2022 without granting any unnecessary adjournments to either of the parties.

There shall be no order as to costs.
