The petitioner participated in a selection process conducted by the Balurghat Municipality.

The petitioner alleges that he was called for interview in the year but thereafter no communication was made by the Municipality to intimate him whether he was successful or not. The petitioner submits that representation was filed before the Municipality but the same has not been answered. The name of the petitioner does not appear in the merit list published by the Balurghat Municipality.

It appears from the submission made on behalf of the petitioner that the petitioner is aggrieved by the inaction on the part of the Municipality to communicate

him as regards the fate of his participation in the selection process.

Fact remains that the Municipality has already published the list of successful candidates. The name of the petitioner not being empanelled in the list of successful candidates, imply that the petitioner became unsuccessful.

As per the selection procedure the Municipality is not required to individually intimate the unsuccessful candidates.

The moment a candidate becomes successful; his/her name is published in the merit list. In view of the above, it is clear that the petitioner became unsuccessful in the selection examination and hence his name did not figure in the merit list. There is no apparent error on the part of the Municipality warranting interference.

The writ petition fails and is hereby dismissed. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
