The petitioners submit that they are coowners in respect of a plot of land measuring an area of 1.77 acres in the district of South 24 Parganas, P.S. Patharpratima, Mouza Indraprastha, J. L. No. 26, Dag No. 598. The western portion except north west corner of the said plot was utilised by the State respondents for the purpose of construction of embankment at Mouza Indraprastha though the land was not acquired in accordance with law. The petitioners, not having received any compensation for the same, submitted a
representation before the concerned Authority on 25th September, which is still pending. The petitioners pray for a direction upon the Authority to consider the representation at the earliest.
Considering the submissions made on behalf of the parties, the writ petition is disposed of directing the 4th respondent to consider and dispose of the representation submitted by the petitioners dated 25th September,2018 within a period of two months from the date of communication of this order after giving reasonable opportunity of hearing to all the interested parties including the petitioners, in accordance with law. The Authority may hold joint inspection of the property for the purpose of demarcation of the same. The decision taken by the Authority shall be communicated to the petitioners within a week thereof.
W.P.A. 3161 of 2021 is thus disposed of.
There shall be no order as to costs.
Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
