Adv., Ms. Manika Pandit ...for the State The petitioner complains that when the Bailiff of the Civil Judge (Jr. Division), 1st Court at Contai, Purba Medinipur went to execute a decree in T. Ex. Case No. 11 of 2019 on January 15, 2019, the judgment debtor restrained him and also threatened the petitioner.

In those circumstances, this Court directs the Patashpur Police Station, Purba Medinipur, to render all assistance to the Bailiff to carry out the order of the Civil Judge (Jr. Division), 1st Court at Contai, Purba Medinipur.

The costs of deploying of force and protection shall be borne by the petitioner.

The petitioner shall be entitled to ask for police protection for the purpose of securing her land after the Bailiff complies with the Executing

Court's order and the same may be complied with by the Office-in-Charge, Patashpur Police Station. The Office-in-Charge, Patashpur Police Station shall also ensure that there is absolutely no breach of peace in the area.

With the aforesaid observations, the instant writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
