Re : An application under Section 482 read with Section 401 of the Cr.P.C. The revisional application was preferred challenging the Order dated 04.01.2021 passed by the learned Sub Divisional Executive Magistrate, Egara, Purba Medinipore in Misc. Case No. 411 of 2020 in connection with an application under Section 144(2) of the Code of Criminal Procedure.

The subject matter of the application under Section 144(2) of the Code of Criminal Procedure was of the year 2020. There was a restrain order passed in the order dated 24.11.2020. Consequently, after 60 days the same is bound to expire.

Having considered the statutory requirements, I am of the opinion that Misc. Case No. 411 of 2020 which was pending before the learned Sub Divisional Executive Magistrate, Egara, Purba Medinipore has become infructuous by efflux of time. As such, the same is to be deemed to be quashed. The revisional application, as such, do not call for any interference by this court in an infructuous proceeding pending before the learned Executive Magistrate.

With the aforesaid observations, the present revisional application being CRR 277 of 2021 is disposed of. Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
