Learned counsel appearing for the petitioner submits that, although there were initial discrepancies in the electric meter, as pointed out by learned counsel for the CESC Limited, subsequently such discrepancies have been taken care of by the petitioner and the CESC Limited, upon being satisfied, is ready to give electric connection, as per the application of the petitioner. Learned counsel appearing for the CESC Limited submits that the petitioner's submissions are correct and the CESC Limited is now satisfied that a new connection can be given to the petitioner in accordance with law, from the existing electric meter board at the premises of the petitioner.

However, an apprehension is expressed by the learned advocates for both the petitioner as well as the CESC Limited regarding some third parties creating hindrance in the connection being given.

Accordingly, WPA 1988 of 2020 (Old No. W.P.No. 1988(W) of 2020) is disposed of by directing the respondent nos. 1 to 3 to give new electric connection to the premises of the petitioner within December 14, 2021, subject to compliance of all formalities. In the event the officials of the CESC Limited face any obstruction in giving such connection, the said officials will be at liberty to approach the respondent no. 4, the Officer-in-Charge, Rajabagan Police Station. In the event such an approach is made, the respondent no. 4 shall immediately provide adequate police assistance to the officials of the CESC Limited, at the cost of the petitioner.

The parties as well as all concerned shall act on the written communication of the learned Advocates of the parties, accompanied by a server copy of this order, without insisting upon prior production of a certified copy thereof.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
