Mr. Chattopadhyay, learned AGP raises a serious dispute with regard to the maintainability of the instant writ petition on the ground that it is bad for mis-joinder of causes of action.

Mr. Jana, learned counsel for the petitioners submits that to avoid controversy, the petitioners may be permitted to withdraw the writ petition with liberty to file afresh separately.

Leave as prayed for is granted.

W.P.A. 2643 of 2024 therefore is dismissed as withdrawn without any order as to costs.

This order will not prevent the petitioners to file fresh writ petition separately for the selfsame relief.
