Mr. S.G. Mukherjee, ld. PP Mr. Imran Ali Ma. Debjani Sahu ... for the State Petitioner is directed to serve a copy of the revisional application upon Mr. Ali, learned advocate, who ordinarily appears on behalf of the State. His appointment may be regularised by the concerned authorities.

Supplementary affidavit so filed be kept with the record.

Learned advocate for the petitioner submits that Alipore Police Station Case No.244/2009 was instituted on 21.11.2009 and the investigating agency on completion of the investigation submitted charge-sheet in the year 2011. Cognisance of the offence was taken by the learned magistrate on or about January, 2012 and since then the case has not proceeded. The charge has not yet been framed and no witness has been examined and the next date is fixed on 7th November, 2023 for appearance.

Having regard to the plight of the complainant, I direct that the learned trial court at least would complete the process of consideration of charges by 31st December, 2023. In case after the charges have been framed, learned trial court is of the opinion to proceed with the case then it would fix at least three dates in every month so that trial of the case can be taken to its logical conclusion within a reasonable period of time.

With the aforesaid observations, CRR 394 of 2023 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order be immediately made available to the parties, subject to compliance with all requisite formalities.
