Heard learned counsels for the parties. Perused the case diary The second petitioner is the paternal aunt of the first petitioner and both the petitioners are in custody for about 165 days. Allegation against them is that they facilitated the abduction and murder of the victim who is the erstwhile husband of the first petitioner. The main thrust of the allegation is against the husband of the first petitioner and his accomplices. The case against the petitioners rests primarily on circumstantial evidence. It is alleged that the petitioners left the house allowing the victim to remain alone in the house to facilitate his abduction and murder. The extent of involvement of the petitioners in the alleged offence shall be determined in the light of the evidence adduced during trial. Material available on record does not justify further detention of the petitioners. The petitioners may be granted bail on stringent conditions.

The petitioners namely Rukshar Begum @ Ruksa Begum @ Puja and Gopa Chakraborty shall be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only) each, with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Howrah subject to condition that they shall cooperate in investigation and shall not tamper with the evidence and intimidate the witnesses in any manner whatsoever. The application for bail is, thus, disposed of. Case diary be returned.
