Heard learned counsels for the parties.

The order passed by the District Magistrate, Purba Bardhaman on 11th July, 2022 is assailed in the writ petition. The order is amenable to appeal under Rule 51 of the West Bengal Minor Mineral Concession Rules, 2016.

In view of the above, learned counsel for the petitioner seeks to approach the appropriate forum for redressal of his grievance.

The writ petition is accordingly dismissed for nonprosecution. Liberty is granted to approach the appropriate forum for redressal of his grievance.

In the event the petitioner approaches the appropriate authority within seven days of receipt of certified copy of the order impugned, the appropriate

authority shall deal with the matter on merits, in accordance with law without going into the issue of limitation.

There shall however, be no order as to costs. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
