1. The affidavit-of-service as filed in Court today is taken on record.

2. By filing the instant writ petition, the writ petitioner has prayed for issuance of a writ of mandamus upon the respondent no.2 for taking appropriate action on the basis of the written complaint as lodged on January 22, 2024.

3. Learned Advocate for the State submits before this Court that he has not been served with any copy of the writ petition and/or any notice regarding listing of this case.

4. However, considering the factum of this case this Court proposes to dispose of the instant writ petition in the manner indicated herein.

5. The respondent no.2, The Superintendent of Police, Jangipur, is hereby directed to take

appropriate action with regard to the letter dated 22.01.2024 as submitted by the writ petitioner and in the event he finds that any cognizable offence has been made out under cover of the letter dated 22.01.2024, the Superintendent, Jangipur Police Station is directed to take appropriate steps through the concerned I.C. of the appropriate police station to initiate a case after lodging F.I.R., if not initiated in the meantime and thereafter proceed with the investigation of the said P.S. case in accordance with law.

6. With the aforementioned observations, the instant writ petition being WPA 2652 of 2024 is hereby disposed of.

7. Liberty is given to the writ petitioner to communicate the server copy of this order to the respondent no.2. Respondent no.2 is hereby directed to act on the server copy of this order.

8. Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities. (Partha Sarathi Sen, J.)
