Petitioner is aggrieved by the fact that although there are no conditions imposed but the private respondents along with villagers and/or their associates are trying to take law in their own hands and restricting the petitioner to enter his own residence. Admittedly, there are two cases which are pending. However, the petitioner is on bail and none of the courts have imposed any condition so that the petitioner cannot enter his own residence.

Having regard to the fact that presently the jurisdictional sessions court is in seisin of S.R. Case No.226 of 2024 arising out of Haripal Police Station Case No.571 of 2024 dated 21.09.2024, I direct the

learned sessions court and/or trial court in seisin of the matter to pass necessary directions upon the police authorities so that if the petitioner is unable to stay at his residence, proper escort may be provided, if otherwise, there is no impediment of law. In case the trial court passes any order, police authorities would respect, obey and implement such order of the learned trial court. Police authorities would also keep a strict vigil and ensure that no breach of the peace and/or tranquility takes place and/or any untoward incident results because of strained relationship existing between the parties.

With the aforesaid observations, WPA 2806 of 2025 is disposed of.

There will be no order as to costs.

Report submitted by the State be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
