The grievance of the petitioner is directed against non-supply of electricity connection to the premises of the petitioner.

On behalf of WBSEDCL, it is submitted that there already exists an electricity connection in respect of the subject premises in the name of the petitioner's mother, Smt. Malaya Devi. In such circumstances, there is no ground for granting of a separate electricity connection. This is a case of splitting of load and there is no justification as to why a separate electricity connection should be granted to the petitioner. It is submitted by both the parties that in view of the nature of disputes raised by WBSEDCL, the matter be referred to the Ombudsman under Section 14 of WBERC Regulation 53 for adjudication.

In view of the above, WPA 2917 of 2026 stands disposed of by directing the Ombudsman to consider

the grievance of the petitioner within a period of 12 weeks on receipt of a representation to the above effect.

It is made clear that there has been no adjudication on the merits of the case and all issues are left open to be decided by the Ombudsman in accordance with law.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
