It is the contention of the learned counsel for the respondent that the sole appellant of this matter has expired on December 27, 2009. No application for substitution has been filed. Moreover, the appellant is not appearing before this Court since long. This promted the respondent to file an application being CAN 3 of 2022 for dismissal of the appeal by recording abatement. Heard the learned counsel for the appellant. Perusing the copy of death certificate placed along with application being CAN 3 of 2022. It appears that the sole appellant has expired on 27.12.2004, no application for

substation has been filed. Moreover, the appellant is not taking any steps.

Considering the same, the instant appeal is hereby dismissed for default.

Connected applications, if any, are also disposed of. Interim order if any, passed by this Court during the pendency of the instant appeal is hereby vacated. TCR, if received, be send down promptly to the learned Trial Court.
