... for the State None appears on behalf of the petitioner. This matter is pending in the list since 15.03.2023 and has been called on each day of working of this Court since that date. In spite of that no one is appearing on behalf of the petitioner. The petitioner is found to be not interest in this case. Therefore, the same is taken up today for disposal on merit. This is a case by the present petitioner praying for quashing of the proceedings being Uttar Para Police Station Case No. 523 dated 21.12.2015, corresponding to G.R. No. 2429 of 2015, pending in the Court of Additional Chief Judicial Magistrate, Serampore, District Hooghly. The case is under Section 406 of the Indian Penal Code. It appears from the ordersheet that the police has submitted FRT in this case. Notice was also issued by the Court to the defacto complainant, that is the present petitioner.
However, in view of the absence of the petitioner throughout the period of pendency of this case and also considering the grounds pleaded by her in the present case, this is my considered opinion that the same are not sufficient and cogent enough to warrant this Court's interference to the criminal proceeding a above. On perusal of the entire materials available on record and the grounds made up by the petitioners I am constrained to find that the grounds thereof are not sufficient and cogent enough to warrant this court's interference into the impugned order. Hence, in my considered opinion the revision is liable to be dismissed.
Criminal Revision being CRR 102 of 2016 is dismissed. All pending applications, if any, are consequently disposed of. Certified website copies of this order, if applied for, be supplied to the parties subject to compliance with all the requisite formalities. (Rai Chattopadhyay, J.)
