Learned advocate appearing for the alleged contemnor submits that the area of encroachment has since been demarcated. He submits that proceedings are to be initiated under the West Bengal Highways Act, 1962 since the encroachment is on a highway within the meaning of the Act of 1962.

In such circumstances, it would be proper to dispose of the contempt petition by requesting the appropriate authorities to initiate appropriate proceedings under the Act of 1962 as expeditiously as possible.

CPAN 109 of 2021 is disposed of.
