Learned counsel appearing for the appellant submits that the appeal has erroneously been filed before this Court, although it is the court of the concerned District Judge which has pecuniary jurisdiction to entertain the appeal.

Accordingly, on the prayer of the appellant, FAT No. 29 of 2026 along with CAN 1 of 2026 are dismissed as withdrawn with liberty to the appellant to prefer an appeal against the selfsame impugned judgment and decree before the appropriate Court having pecuniary jurisdiction. 3.

There will be no order as to costs.
