akb Mr. Sanat Kumar Roy Mr. Abhishek Banerjee ...For the Petitioner Mr. Amal Kumar Sen Mr. Suman Sengupta ...For the State Respondents Learned Counsel appearing on behalf of the petitioner submits that in the light of the new notification of the Transport Department, Government of West Bengal, he may be granted liberty to withdraw this writ petition and file an application afresh. He further submits that the said fresh application should be considered in accordance with law keeping in mind that earlier resolution of the RTA Board had granted him permit.

I have heard learned Counsel appearing on behalf of the parties and perused the materials placed on record. In my view, this writ petition can be disposed of with liberty granted to the petitioner to approach the authorities with a fresh application. The authorities are directed to expeditiously consider the application of the petitioner in accordance with law keeping in mind the earlier offer that had been issued to him and in the light of the present notification.

With these observations, the writ petition is disposed of.

Since, no affidavit-in-opposition has been called for, the allegations made in the writ petition are deemed to have not been admitted by the respondents.

There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of all formalities, on priority basis.
