07.02.2023 Sl. No.42 akd [Rejected] C. R. M. (DB) 488 of 2023 In Re: An application for bail under Section 439 of the Code of Criminal Procedure filed on 01.02.2023 in connection with Kaliachak Police Station Case No.814 of 2021 dated 06.08.2021 under Sections 302/34 of the Indian Penal Code. (G.R. Case No.4153 of 2021) And In Re: Nikhil Ghosh ... ... Petitioner Ms. Minoti Gomes Mr. Musharraf Alam Sk.

... ... for the petitioner Ms. Zareen N. Khan Mr. Arup Sarkar ... ... for the State Petitioner renews his prayer for bail. It is submitted on behalf of the petitioner that he is in custody for about 542 days. Learned Advocate for the State opposes the prayer for bail. We have considered the materials on record. There are ample materials connecting the petitioner with the murder of two persons. Bail prayer of the petitioner was rejected on merits earlier. There is no change in circumstance since then. Accordingly, we are not inclined to grant bail to the petitioner at this stage.

The application for bail is thus rejected.

Trial court is directed to consider the issue of framing of charge at the earliest and in the event, charge is framed to take the proceeding to its logical conclusion without granting unnecessary adjournments to either of the parties.
