CIVIL REVISIONAL JURISDICTION (Via Video Conference) CO 363 of 2020 Subrata Das -versus- Surajit Mondal Mr. Koustav Bagchi, ... for the petitioner/plaintiff.

In view of the order proposed to be passed for speedy disposal of the applications pending before the learned Court below, the opposite parties cannot be prejudiced. As such, service of notice of the present revisional application upon the opposite parties is dispensed with.

The grievance of the petitioner is that in the suit for eviction filed by him the defendant filed applications under Sections 7(1) & 7(2) of the West Bengal Premises Tenancy Act, 1997 as long back as on November 15, 2019, but the same have not yet been disposed of.

In view of the intervening unusual circumstances prevailing due to pandemic, the delay in disposal cannot be wholly attributed to the Trial Court.

However, for the ends of justice, the revisional application is disposed of with a direction upon the learned Trial Judge to dispose of the said applications under Sections

7(1) & 7(2) of the West Bengal Premises Tenancy Act, 1997 within a period of three months from the date of communication of this order without granting any unnecessary adjournment to either of the parties.

CO 363 of 2020 is thus disposed of. No order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the party subject to compliance of all requisite formalities.
