I am told that the appeal has been released.

I have heard the parties in extenso.

However, considering the submission of the petitioner that an appeal is pending from the order passed by this court on 05.10.2023, the matter should be adjourned for some days, I adjourn the matter till 3 p.m. tomorrow.

However, it is noted by this court that despite service of notice the respondent nos. 25 and 26, Dr. Sunanda Goenka (nee Bhattacharya) and Dr. Achina Kundu (nee Majumder Bhattacharya), have not appeared before this court though the respondent no. 25 has preferred an appeal, being MAT 2009 of 2023. However, on 6th October, 2023 both of them were present.

The second report of the Special Officer dated 09.10.2023 has been filed and is kept on record. Let copy of both the reports filed today be served upon the appearing parties only.

The Special Officer is given the power and authority to act as the Drawing and Disbursing Officer ('DDO', for short) for the salary and remuneration to be

disbursed. Bill for the month of October, 2023 has been sent digitally on 5th October, 2023 to the Pay and Accounts Officer, Kolkata Pay and Accounts Office-II. The Pay and Accounts Officer, Kolkata Pay and Accounts Office -II is directed to accept the signature of the Special Officer, Mr. Arka Kunar Nag, for performing the duties of DDO in the interregnum period.

I appoint Mr. Maazul Haque, the senior most teacher of the said law college to act as the Teacher-inCharge and to perform the academic duties of the Principal until further order.

I direct the Special Officer to issue a notice to the erstwhile Principal Dr.

Sunanda Goenka (nee Bhattacharya) intimating that she should be present in the college for opening the lock put by her on the door of her chamber so that necessary papers and documents can be taken out of the said chamber by the Special Officer in the presence of the police authority. It is to be done during the college hours on 10th October, 2023.

List the matter accordingly.
