The petitioner alleges that a false complaint has been made against him by his brother's wife. His brother's wife left the matrimonial house some time in April, 2019. The allegation is that some time in June, 2019, the petitioner tried to rape her.

We have seen the material in the Case Diary including the statement of the complainant recorded under Section 164 of the Code. We are of the opinion that the petitioner need not be taken into custody immediately. Accordingly, in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand), with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer of the concerned police station and shall abide by the conditions laid down in Section 438(2) of the Code of Criminal Procedure until further orders and on further condition that the petitioner shall not enter the jurisdiction of Murshidabad Police Station until further

orders. The petitioner shall also furnish the address where he will be residing to the Investigating Officer. The application for anticipatory bail being CRM 1236 of 2021 is, thus, allowed.
