This revisional application seeks expeditious disposal of an application under Section 7(2) of the West Bengal Premises Tenancy Act, 1997 filed in connection with Title Suit No. 457 of 2016 pending before the learned Civil Judge (Senior Division), 3rd Court at Howrah as also the said suit itself.

Mr. Mitra, learned Advocate appearing for the petitioner invites the attention of this Court to an order dated April 03, 2023 passed by a Coordinate Bench of this Court in C.O. 283 of 2023 thereby requesting the learned Trial Court to dispose of the application under Section 7(2) of the West Bengal Premises Tenancy Act, 1997 within one month from the date of receipt of a copy of the order. It is submitted by Mr. Mitra, learned Advocate appearing for the petitioner that the said application is still pending.

In view of the nature of the order proposed to be passed by this Court, direction for prior service of notice along with a copy of the revisional

application on the opposite party is not being made, however, the petitioner shall remain obliged to serve a copy of the revisional application along with a copy of this order upon the opposite party within a week from date.

Having heard Mr. Mitra, learned Advocate appearing for the petitioner and having considered the material-on-record, especially the earlier order dated April 03, 2023 passed in C.O. 283 of 2023 the learned Trial Court is requested to dispose of the pending application under Section 7(2) of the said Act of 1997 expeditiously so as to ensure that the petitioner is not required to travel to this court once again seeking expeditious disposal of the same application.

Since the suit is of the year 2016, the learned Trial Court is further requested to dispose of the same as expeditiously as possible and preferably within a period of one year from the date of disposal of the application under Section 7(2) of the said Act of 1997.

C.O. 424 of 2026 stands disposed of. No costs.

7. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
