Learned advocate appearing for the petitioner submits that the petitioner is in custody in excess of two years. There is hardly any possibility of the trial concluded in time soon. He submits that there is eyewitness implicating the petitioner to the incident.

Learned advocate appearing for the State submits that the prayer for bail was rejected twice before. He submits that trial is in progress and by the order dated February 16, 2022 next date for recording evidence of the prosecution witnesses was fixed on March 28, 2022, March, 29, 2022 and March 30, 2022.

Considering the gravity of the offence and the involvement of the petitioner therein and considering the

fact that there is hardly any change in circumstance in favour of the petitioner subsequent to the earlier order of rejection and considering the fact that trial is in progress, we are not inclined to grant bail to the petitioner. Prayer for bail of the petitioner is rejected. We, however, request the learned Court in seisin of the trial to dispose of the same as expeditiously as possibly without granting any unnecessary adjournments to any of the parties.

CRM(DB) 449 of 2022 is dismissed.
