Rakib (Allowed) CRM (M) 385 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Krishnaganj Police Station case no. 288 of 2025 dated 01.07.2025 under Section 140(3) of the BNS, 2023 and Sections 6/17 of the POCSO Act, 2012 and under Sections 9/10/11 of the Prohibition of Child Marriage Act, 2006. Liberty is granted to the learned advocate appearing for the petitioner to amend the Cause Title.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 200 days and he may be released on bail on any stringent conditions.

Learned advocate for the State opposes the prayer for bail and produces the Case Diary.

I have checked the statement under Section 164 of Cr.P.C./Section 183 of BNSS of the victim. I do not find that the victim has implicated the present petitioner in her statement before the Magistrate. Consequently, I am of the opinion that further detention of the present petitioner is unwarranted. As such, the prayer for bail of the petitioner is allowed.

Accordingly, petitioner namely, Samrat Roy shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Additional Sessions Judge, 2nd Court, (Special Court) under POCSO Act, Nadia, Krishnanagar.

If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial Court and shall not leave the jurisdiction of District of Nadia without the prior permission of the learned trial Court.

Accordingly, the application for bail being CRM (M) No. 385 of 2026 is allowed.

Service report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
