The petitioner has applied for revocation of a grant of probate giving rise to Misc. Case No. 69 of 2013 pending before the 5th Court of learned Additional District Judge at Barasat, District : 24 Parganas (North).

A Co-ordinate Bench of this Court by an order dated August 06, 2018 passed in CO 2527 of 2018 has directed expeditious disposal of the said misc. case.

It appears from the order no. 56 dated December 21, 2020 that the learned Trial Judge in terms of such direction is taking appropriate steps for expeditious disposal of the said misc. case.

The petitioner who appears in person informs this Court that yesterday (04.02.2021) evidence of the handwriting expert has been partly recorded and the learned Trial Judge has fixed March 03, 2021 as next date for further evidence of the said witness.

In view of satisfactory progress in disposal of the said misc. case, further direction for expeditious disposal of the said misc. case is not necessary.

CO 222 of 2021 is disposed of with the above terms. No order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the party subject to compliance of all requisite formalities.
