Petitioner seeks bail.

Learned Advocate appearing for the petitioner submits that the petitioner is in custody since October 16, 2021. The police submitted charge sheet. According to him, there is no evidence against the petitioner apart from the statements of the co-accused recorded under Section 164 of the Code of Criminal Procedure. He invites the Court to go through the entirety of such statements.

Learned Advocate appearing for the State draws the attention of the Court to the contents in the case diary including the statements of the co-accused recorded under Section 164 of the Code of Criminal Procedure. He submits that the wife of the victim is the co-accused who recorded such statements.

Considering the gravity of the offence and considering the involvement of the petitioner as transpiring from the materials available in the case diary, we are unable to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner is rejected.

However, we request the jurisdictional Court to frame the charges as expeditiously as possible.
