Petitioner is aggrieved by the fact that she has been deprived by her mother and sister both in respect of the funds which have been inherited as also the land/property in issue.

Petitioner complains that so far as the accounts are concerned, information was furnished to the police authorities in the year 2023. But till date the police authorities did not take any action neither in respect of the property nor the accounts.

State has submitted a report. The report deals with the property in question but certain facts have been divulged by the police authorities. So far as the funds are concerned, police did not deal with the same in their report.

Since a substantial time period has passed since submission of the letter of complaint addressed to the concerned police station, I direct the petitioner to approach the jurisdictional Magistrate under section 175(3) of the BNSS by way of addressing in respect of the relevant offences committed by or at the behest of the private respondents being the mother and the sister.

Learned Magistrate would consider whether any cognizable offence has been made out as also whether any case for investigation is made out and pass necessary orders adhering to the provisions of law.

With the aforesaid observations WPA 2682 of 2024 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
