Mr. Dutta, learned counsel for the State submits that the prosecution filed final report in the form of closure of investigation on 1.2.2026 stating that the ingredients of the offence punishable under Section 316(2)/318/61(2) of the BNS are not made out and the dispute between the parties is purely civil and commercial in nature arising out of business transaction. No criminal intent could be established at the inception of the transactions and therefore no cognizable criminal offence has been made out.

In such circumstances, the instant application being CRR 554 of 2025 is disposed of as infructuous and connected application being CRAN 1 of 2026 is also disposed of as infructuous.
