The subject matter of the writ petition relates to a 16.07.2025 Court No. 35 M/L. No.773 Rakib private dispute over installation of tower. There was a representation by number of individuals resisting the act of installation of tower.

Mr. Panda, Learned advocate appearing for the State has submitted a report. Report reflects that there has been a long standing dispute over an un-demarcated property. Police authorities at the relevant point of time have drawn up proceedings under Sections 107/116 of the Code of Criminal Procedure.

Having considered the nature of the dispute, I am of the opinion that police authorities have hardly any scope to interfere without any specific order from the Civil Court.

So far as the surveillance is concerned at the relevant point of time, police authorities took steps in an appropriate manner. If similar inconveniences are faced so far as law and order are concerned, police authorities would execute their duties.

With the aforesaid observations WPA 2783 of 2024 is disposed of.

Report so submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
