[ Mr. Dhiraj Kr. Gupta Mr. Swarup Saha ...for the petitioner This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Judge, 11th Bench, City Civil Court, Calcutta to dispose of the Ejectment Suit No. 16 of 2019.

The learned Advocate appearing for the petitioner submits that an application under Section 7(2) of the West Bengal Premises Tenancy Act, 1997 filed by the defendant/opposite party and an application under Order 39 Rule 7 of the Code of Civil Procedure filed by the petitioner are pending. He further submits that dates of hearing of the application under Section 7(2) of the Premises Tenancy Act, 1997 has been fixed on 1st July, 2026. He further submits that the said application is otherwise ready for hearing. He also submits that the application filed under Order 39 Rule 7 of the Code of Civil Procedure is otherwise ready for hearing. In view of the order sought and proposed to be passed, there is no necessity to serve notice upon the opposite party. However, the learned Advocate-on-Record for the petitioner shall be obliged to forward a copy of this application along with a server copy of this order to the opposite party forthwith.

In the light of the submission made by the learned Advocate for the petitioner, this civil revisional application stands disposed of by requesting the learned Judge, 11th Bench, City Civil Court, Calcutta to take up the hearing of the application under Section 7(2) of the West Bengal Premises Tenancy Act, 1997 on the next date i.e. 1st July, 2026, if the same is otherwise ready for hearing and make an endeavour to dispose of the same as expeditiously as possible but preferably within a period of eight weeks from the next date fixed without granting any unnecessary adjournments to either of the parties.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requite formalities.
